This can be used for a 120/240 volt 40 amp circuit to the hot tub spa panel if the spa panel is mounted on the house and the NM-B cable enters the enclosure through the back, NM-B cable cannot be used outside. The circuit between the spa panel and spa controller is required by the NEC to have an insulated equipment grounding conductor so the best thing to use is individual THHN/THWN conductors in conduit.
