    BASICS OF YOUR MyLowe's ACCOUNT

    • Registration.

      Upon successfully signing up for MyLowe's, your MyLowe's card ("MyLowe's card") with its unique identifying number, can be used when shopping at Lowe's stores and will be automatically included with purchases made on the Lowes.com, which will allow us to track and record your purchases for you, including, but not limited to: product description, quantity purchased, purchase price, date of purchase as well as such things as the formula for specific paint colors you purchased or the size of HVAC filters you purchased.
    • Tracked Purchases.

      Lowe's will track all of the purchases that you make in store when you present your MyLowe's card or the phone number affiliated with your MyLowe's card, during the transaction. Additionally, all purchases you make while registered on Lowes.com will also be tracked and available in your MyLowe's's Account. These transactions are called "Tracked Purchases."
    • Submissions.

      As a MyLowe's user, you will be able to review your Tracked Purchases. You will also be able to upload to your MyLowe's account additional information or data, making your MyLowe's account a powerful tool for managing your home improvement projects. For example, you will be able to submit product wish lists, project pictures, information about which paint purchases are related to specific rooms in your home, and a record of when you last changed your HVAC filters. The information or data that you upload or enter into your MyLowe's account is called "Submissions." Lowe's reserves the right to supervise the uploading of any Submissions, but Lowe's is under no obligation to do so. By submitting a Submission you certify that either (i) you are at least eighteen (18) years old or are an emancipated minor and have the right to submit the information, or (ii) are over the age of 13 and you have obtained your parent's or legal guardian's express consent to submit the information and to grant the licenses provided hereunder.
    • Communications from Lowe's.

      By registering for MyLowe's, you agree and opt in to receive advertising, marketing materials, and other communications including email from Lowe's, Lowes.com, and their affiliates. For example, if your MyLowe's account contains information about a landscaping project on which you are working, Lowe's may send you information on proper planting techniques or a promotion on plant materials. You will have the ability to tailor your communication preferences after completion of your registration.
    • Username and Password.

      As part of the registration process, you will be asked to select a username and password. Lowe's may refuse to grant you a username that impersonates someone else, is or may be illegal, is or may be protected by trademark or other proprietary rights law, is vulgar or otherwise offensive, or may cause confusion, as determined by us in our sole discretion. You agree not to transfer, resell, share, allow unauthorized persons to use or otherwise facilitate access to the site by any unauthorized third party your use of or access to the Site to any third party. If you have reason to believe that your account with us is no longer secure, you must promptly change your password on your MyLowe's account and immediately notify Lowe's of the problem by contacting Lowe's customer care via e-mail at (customercare@lowes.com) or telephone (1-(800) 445-6937) YOU ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR USERNAME AND PASSWORD AND FOR ANY AND ALL ACTIVITIES (INCLUDING PURCHASES) THAT ARE CONDUCTED THROUGH YOUR MyLowe's ACCOUNT.

    WHO CONTROLS SITE CONTENT AND INFORMATION

    • Your Submissions.

      For any Submissions that are covered by any intellectual property rights ("IP Content"), you grant Lowe's a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license in perpetuity to use those Submissions ("IP License") as Lowe's sees fit.
    • The IP License ends when you delete your IP Content from your MyLowe's account, unless your IP Content has already been used outside your MyLowe's account and/or shared with others, and they have not deleted it.
    • You understand that deleted IP Content may persist in backup copies of your MyLowe's account for a reasonable period of time, but the deleted IP Content will not be available for your use or review from your MyLowe's account once it has been deleted.
    • Tracked Purchases.

      Lowe's owns all of the data and information concerning your Tracked Purchases, but subject to these Terms of Service Lowe's may make your tracked purchases available to you for viewing through your MyLowe's account. Lowe's will continue to own all of the data and information concerning your Tracked Purchases even if your MyLowe's account is deactivated for any reason.
    • Ownership and Restrictions on Use.

      The Site is owned and operated by Lowe's Home Centers, Inc. in conjunction with others pursuant to contractual arrangements. The Site, the Site Content (defined below), any and all software, together with all intellectual property and other rights relating to each of the foregoing, are and will remain the property of Lowe's and its licensors and suppliers, but Lowe's neither warrants nor represents that your use of the Site Content will not infringe the rights of any party. The Site Content and the selection, compilation, collection, arrangement, assembly and look and feel of the Site, thereof are protected by U.S. and international copyright, trademark and other laws, and you acknowledge that these rights are valid and enforceable. The Site Content may be used solely to the extent necessary for your authorized use of the Site, as provided in these Terms of Service or as expressly authorized in writing by Lowe's or, if so indicated in writing by Lowe's, its licensors or suppliers. Modification of the Site Content or use of the Site or Site Content for any other purpose, including the use of contact information provided on the Site for any unauthorized purpose, including marketing, is a violation of our copyright and other proprietary rights and these Terms of Service, and is strictly prohibited. You acknowledge that you do not acquire any ownership rights by using the Site or the Site Content.
    • Trademarks.

      The trademarks, logos, and service marks displayed on the Site (collectively the "Trademarks") are the registered and unregistered trademarks of Lowe's, Lowe's licensors and suppliers, and others. Nothing contained on the Site should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Trademark without the express written permission of Lowe's, Lowe's licensors or suppliers, or the third party owner of any such Trademarks. Misuse of any Trademarks is prohibited. All other trademarks not owned by Lowe's or its subsidiaries that appear on MyLowe's are the property of their respective owners, who may or may not be affiliated with, connected to or sponsored by Lowe's or its subsidiaries or affiliates.
    • Site Content.

      The information and materials ("Site Content") provided through the Site, including any data, text, design, graphics, icons, audio clips, images, downloads, and interfaces, about products, projects and services available from Lowe's are the property of Lowe's, its vendors, licensors or suppliers. You agree you will not alter or modify any part of the Site. You may not engage in the unauthorized use, copying, or distribution of any of the Site Content. You may not otherwise reproduce, display, publicly perform, or distribute Site Content in any way for any public or commercial purpose.
    • Accuracy of Information Provided by Lowe's.

      Although Lowe's strives to provide Site Content that is both useful and accurate, the nature of the data and other information contained on the Site is subject to frequent change. In addition, some of the Site Content has been contributed by third parties. The inclusion of such information does not indicate any verification, approval or endorsement thereof by Lowe's, and Lowe's expressly disclaims any liability for the accuracy of any information on the Site. The Site Content is provided for general information only and should not be relied upon or used as the basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the Site Content is at your own risk. The Site may contain certain historical information, which is not necessarily current. We reserve the right to modify the Site or the Site Content at any time, but we have no obligation to update any information on the Site.

    CODE OF CONDUCT

    • You shall be solely responsible for your own Submissions. In connection with Submissions and your access to the Site, you affirm, represent and warrant that you own, or have the necessary licenses, rights, consents, and permissions to the Submissions, and you agree that you will not do any of the following things (collectively, the "Code of Conduct"):
      • Restrict or inhibit any other visitor or member from using the Site, including, without limitation, by means of "hacking" or defacing any portion of the Site;
      • Use the Site or Site Content for any unlawful purpose;
      • Express or imply that any statements you make are endorsed by Lowe's;
      • Make a Submission or otherwise transmit material that (a) is copyrighted, protected by trade secret or otherwise subject to third party proprietary or intellectual property rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material; (b) is unlawful, obscene, defamatory, libelous, threatening, fraudulent, abusive, pornographic, harassing or encourages conduct that would be considered a criminal offense, or does or could give rise to civil liability or violate any law, rule or regulation, or is otherwise objectionable, or infringes our or any third party's intellectual property or other rights; (c) is intended to victimize, harass, degrade or intimidate an individual or group of individuals on the basis of age, disability, ethnicity, gender, race, religion or sexual orientation; or (d) is non-public information about a company or individual without the express written authorization to do so;
      • Engage in spamming, flooding, phishing or any other activity intended to gather information unlawfully;
      • Transmit any software or other materials that contain any viruses, worms, trojan horses, salamis, defects, date bombs, time bombs or other items of a harmful nature;
      • Modify, adapt, sub-license, translate, sell, reverse engineer, decompile or disassemble any portion of the Site;
      • Remove any copyright, trademark or other proprietary rights notices contained on the Site;
      • "Frame" or "mirror" any part of the Site without our prior written authorization;
      • Use any robot, spider, site search/retrieval application or other manual or automatic device or process to retrieve, index, data mine or in any way reproduce or circumvent the navigational structure or presentation of the Site or its contents;
      • Harvest or collect information about Site visitors or members;
      • Take any action that imposes an unreasonable or disproportionately large load on our infrastructure.
    • While using the Site and the Site Content, you agree to comply with all applicable laws, rules and regulations.
    • Lowe's has the right, but not the obligation, to delete and otherwise remove permanently from the Site and any storage medium any Submission or part thereof in Lowe's sole discretion, regardless of whether such Submission is in breach of the Code of Conduct.
    • If you use the Site, you agree to (a) provide accurate, current and complete information about yourself, and (b) maintain and update your information to keep it accurate, current and complete. You understand and acknowledge that, if any information provided by you is untrue, inaccurate, incomplete or not current, Lowe's may terminate your MyLowe's account.

    DEACTIVATION OF YOUR ACCOUNT AND TERMINATION OF SERVICE

    • Deactivation of your account.

      Lowe's reserves the right in its sole discretion to remove or delete any or all material from your MyLowe's account or the Site at any time. Additionally Lowe's may deactivate your account for any reason and in its sole discretion. Deactivation of your MyLowe's account for any reason, including by your request or as a result of account inactivity, may result in all data and information uploaded by you or Lowe's, regardless of source, no longer being accessible to you, even if you decide to open a new MyLowe's account. Lowe's has no obligation to make an electronic copy of your Submissions or the Tracked Information available to you at any time, including upon deactivation of your MyLowe's account for any reason.
    • Termination of Service.

      Lowe's reserves the right to terminate immediately the Site, these Terms & Conditions, and/or your access to and use of your MyLowe's account or any portion thereof, without liability, at any time and for any reason, with or without cause.
    • Upon deactivation of your account or termination of the MyLowe's Site and /or the Terms of Service, or upon your violation of these Terms of Service, your right to use the Site will immediately cease.

    PURCHASES AND TRANSACTIONS

    • Making purchases.

      If you wish to purchase products or services described on the Site, you will be asked to supply certain information applicable to your purchase, including, without limitation, credit card and other information. Your MyLowe's account will provide you a secure location to store your information and allow you to make a future purchase without re-entering information. You agree to pay all charges incurred by you or any users of your account and credit card (or other applicable payment mechanism) at the price(s) in effect when such charges are incurred. You will also be responsible for paying any applicable taxes relating to your purchases.
    • Lowe's reserves the right, without prior notification, to change descriptions of or references to products or services on the Site, to limit the order quantity on any product or service and/or to refuse service to you. Verification of information applicable to a purchase may be required prior to Lowe's acceptance of any order. Price and availability of any product or service are subject to change without notice.
    • Acceptance of Orders.

      Receiving an order acknowledgement via email does not guarantee the acceptance of an order. Lowes.com reserves the right to limit the quantity of items ordered and/or refuse to sell to any customer.
    • Links.

    • Claims of Copyright Infringement.

      If you believe any materials accessible on or from the Lowes.com site (including the content of other users' posts and submissions) infringe your copyrights, you may request removal of those materials (or access thereto) by submitting a notification pursuant to the Digital Millennium Copyright Act ("DMCA") to Lowe's designated Copyright Agent (identified below) which sets forth the following information:

    • Reinstatement Process.

      If your Submission was removed (or access thereto is disabled), and you believe such Submission is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the content in your Submission, you may send a counter-notice containing the following information to Lowe's designated Copyright Agent:
      • Your original or electronic signature;
      • Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
      • A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content;

    DISPUTE RESOLUTION

    • Applicable law and forum.

      You agree that this agreement and your use of MyLowe's are governed by the laws of the state of North Carolina, United States, without regard to its choice of law provisions. You hereby consent to the exclusive jurisdiction and venue of the courts, tribunals, agencies and other dispute resolution organizations in Charlotte, North Carolina, United States in all disputes (a) arising out of, relating to or concerning MyLowe's or Lowes.com and / or this agreement, (b) in which the Site and / or this agreement is an issue or a material fact, or (c) in which the Site and / or this agreement is referenced in a paper filed in a court, tribunal, agency or other dispute resolution organization.
    • Waiver of punitive damages claims.

      Pursuant to this agreement, you waive, to the fullest extent allowed by law, any claims for punitive or exemplary damages and any right to pursue claims on a class or consolidated basis or in a representative capacity, which relate in any way to MyLowe's, Lowes.com or this agreement.
    • Binding arbitration.

      Please read this section carefully. It affects rights that you may otherwise have. It provides for resolution of most disputes through arbitration instead of court proceedings. Arbitration is final and binding and subject to only very limited review by a court. This arbitration clause shall survive termination of this agreement. This provision is intended to be interpreted broadly to encompass all disputes or claims arising out of or relating to your use of the Site. Any dispute or claim made by you against us (or against any of our subsidiary, parent or affiliate companies) arising out of or relating to this agreement or your use of the Site (whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory) will be resolved by binding arbitration except that you may take claims to small claims court if they qualify for hearing by such a court.
    • Arbitration Procedures.

      You must first present any claim or dispute to us by contacting our Customer Care Center to allow us an opportunity to resolve the dispute. You may request arbitration if your claim or dispute cannot be resolved within 60 days. The arbitration of any dispute or claim shall be conducted in accordance with the then current and applicable rules of a Nationwide Arbitration Organization as modified by this agreement. You and Lowe's agree that this agreement evidences a transaction in interstate commerce and this arbitration provision will be interpreted and enforced in accordance with the U.S. Federal Arbitration Act and federal arbitration law. Unless you and Lowe's agree otherwise, any arbitration will take place in Charlotte, North Carolina, and will be conducted in the English language. An arbitrator may not award relief in excess of or contrary to what this agreement provides, order consolidation or arbitration on a class wide or representative basis, or award punitive damages or any other damages aside from the prevailing party's actual damages, except that the arbitrator may award on an individual basis damages required by statute and may order injunctive or declaratory relief pursuant to an applicable consumer protection statute. In any arbitration applying those rules applicable to large/complex cases, the Arbitrators must also apply the Federal Rules of Evidence, and the losing party may have the award reviewed in accordance with the review procedures set forth in the selected arbitrator's rules. Any arbitration shall be confidential, and neither you nor Lowe's may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement or appeal of the arbitration award. Judgment on any arbitration award may be entered in any court having proper jurisdiction. If any portion of this arbitration clause is determined by a court to be inapplicable or invalid, then the remainder shall still be given full force and effect.
    • Costs of arbitration.

      All administrative fees and expenses of arbitration will be divided equally between you and Lowe's. Each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration hearing.

    MISCELLANEOUS

    • The Site is intended only for U.S. residents.

      The Site is solely directed to individuals residing in the United States. Lowe's makes no representation that Materials available on or through the Site are appropriate or available for use in other locations. Those who choose to access the Site from other locations do so on their own initiative and at their own risk, and are responsible for compliance with local laws, if and to the extent such laws are applicable. Use of MyLowe's is unauthorized in any jurisdiction that does not give full effect to all provisions of this agreement, including without limitation this paragraph and the warranty disclaimers and liability exclusions above. Lowe's makes no representation that materials on this Site are appropriate or available for use in any particular jurisdiction. Any use in contravention of this provision or any provision of this agreement is at your own risk, and if any part of this agreement is invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the agreement shall govern such use.
    • Information Related to Your MyLowe's Account May Be Subject to Legal Process.

      Your Tracked Purchases, Submissions, IP Content and other information related to your MyLowe's account may be subject to legal process (e.g., subpoena) by Lowe's or a third party or government entity, even if that information has been deleted but still remains in backup form. You acknowledge and understand that Lowe's will comply with all applicable legal obligations in making such information available pursuant to any valid legal process. Lowe's has no obligation to give you notice of any legal process that may result in any information related to your MyLowe's account being produced or otherwise disclosed.
    • Indemnification.

      You agree to indemnify, defend and hold the Lowe's Home Centers, Inc., and its affiliates and subsidiaries, harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys' fees) and other expenses that arise directly or indirectly out of or from (a) your breach of these Terms of Service, including any violation of the Code of Conduct, above; (b) any allegation that any Submissions or other materials you submit to us or transmit to the Site infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party; and/or (c) your activities in connection with the Site.
    • Lowe's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Lowe's right to comply with law enforcement requests or requirements relating to your use of this Site or Lowes.com or information provided to or gathered by Lowe's with respect to such use. You agree that Lowe's may at any time and without notice change the terms, conditions and notices under which MyLowe's is offered. In the event we make material changes to the Terms of Service, notice of the changes will be communicated to you electronically, either via e-mail or via hyperlink on the MyLowe's home page.
    • You agree that no joint venture, partnership, employment or agency relationship exists between you, your service providers or suppliers and Lowe's as a result of this agreement or your use of MyLowe's.
    • Any rights not expressly granted herein are reserved to Lowe's.
    • This agreement, and the terms of sale constitute the entire agreement between you and Lowe's with respect to MyLowe's. This agreement supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and Lowe's with respect to MyLowe's. No modification of this agreement shall be effective unless it is authored by Lowe's or unless it is physically signed in blue ink by a Lowe's executive officer. Any alleged waiver of any breach of this agreement shall not be deemed to be a waiver of any future breach. A printed version of this agreement and/or of any notice given by Lowe's in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement or your use of our Site to the same extent and subject to the same conditions as other business documents and records originally generated and maintained by Lowe's in printed form.
    • Assignment.

      Lowe's may assign all or part of this agreement without such assignment being considered a change to the Agreement, and without notice to you. Lowe's is then released from any liability. The assignee shall have the same rights and obligations as the assignor and shall agree in writing to be bound by the terms and conditions of this agreement.
