What are the terms and conditions of an international sale?
Customer acknowledges and agrees with the following in connection with this transaction: (a) terms of sale are “EX WORKS”, as such term is defined under Incoterms 2000; (b) customer is the “Principal Party in Interest” for purposes of all rules, regulations, and/or laws applicable to the transaction; (c) customer has authorized its freight forwarder to act as customer's agent in connection with the transaction and to ensure completion of all necessary and appropriate documentation for the transaction to be properly classified as a “Routed Export Transaction”, as such term is defined under applicable law; (d) customer or its freight forwarder will, at Lowe's request, provide copies of any export, shipping or import documentation prepared by customer or its freight forwarder related to the transaction to Lowe's at no cost; (e) any and all warranties or guarantees which may otherwise have been applicable to the transaction and/or the products purchased in connection therewith are invalid outside the US; (f) sales are prepaid and product will not leave the store until full payment has been received for product and any associated services including delivery and/or crating; (g) customer is responsible to ensure compliance with all rules, regulations, and laws applicable to the transaction and/or any use, movement, or transfer of the products purchased in connection therewith, including but not limited to U.S. economic sanctions and export control laws and regulations; (h) customer (including its agents, affiliates and principals) represents and warrants that neither the customer nor the country of destination has been, nor is it currently, designated as a, nor is it associated with any, party or country designated or recognized on any restricted list maintained or utilized by the U.S. government or any of its agencies, bureaus, or other organizations; (i) customer is purchasing the products for its own use and not for further distribution or resale; (j) customer is responsible for all freight and any taxes, duties, fees, or other costs associated with transporting the products from the U.S. to the country of destination; (k) customer is responsible for obtaining any licenses or official authorizations required by the destination country and/or under any and all applicable US regulations; (l) any commodities, technology and software will be exported from the US in accordance with the Export Administration Regulations (“EAR”); and (m) customer accepts all risk of loss and/or damage to the product purchased in connection with the transaction after such product leaves the store.
